B. Terms of Service

Dream Troopers AB's products and services are provided by Dream Troopers AB. These Terms of Service ("Terms") govern your access to and use of Cruncho's website, products, and services ("Products"). By accessing or using our Products, you agree to be bound by these Terms and by our Privacy Policy.

1. Using Cruncho
a. Who can use Cruncho

You may use our Products only if you can form a binding contract with Dream Troopers AB, and only in compliance with these Terms and all applicable laws. When you create your Cruncho account, you must provide us with accurate and complete information. Any use or access by anyone under the age of 13 is prohibited. If you open an account on behalf of a company, organization, or other entity, then (a) "you" includes you and that entity, and (b) you represent and warrant that you are authorized to grant all permissions and licenses provided in these Terms and bind the entity to these Terms, and that you agree to these Terms on the entity's behalf. You agree that we may automatically upgrade the Products, and these Terms will apply to such upgrades.

b. Our license to you

Subject to these Terms and Privacy Policy we grant you a limited, non-exclusive, non-transferable, and revocable license to use our Products.

c. Restrictions

Posting Restrictions

You are not allowed to post anything that: (i) Is sexually explicit or pornographic; (ii) Attacks, bullies or harasses others; (iii) Includes hate speech; (iv) Is violent or gory; (v) Infringes anyone's intellectual property, privacy or other rights; (vi) Is fraudulent or deceptive; (vii) Is someone else's personal information or requests a minor's personal information; or (viii) Contains any information or content that’s illegal.

Usage Restrictions

You also are not allowed to engage in any of the following prohibited activities: (i) copying, distributing, or disclosing any part of the Products in any medium, including without limitation by any automated or non-automated "scraping"; (ii) using any automated system, including without limitation "robots," "spiders," "offline readers," etc., to access the Products in a manner that sends more request messages to Cruncho than a human can reasonably produce in the same period of time by using a conventional online web browser or mobile application; (iii) transmitting spam, chain letters, or other unsolicited email; (iv) attempting to interfere with, compromise the system integrity or security or decipher any transmissions to or from the servers running the Products; (v) taking any action that imposes, or may impose at our sole discretion an unreasonable or disproportionately large load on our infrastructure; (vi) uploading invalid data, viruses, worms, or other software agents through the Products; (vii) collecting or harvesting any personally identifiable information, including account names, from the Products; (viii) using the Products for any commercial solicitation purposes; (ix) impersonating another person or otherwise misrepresenting your affiliation with a person or entity, conducting fraud, hiding or attempting to hide your identity; (x) interfering with the proper working of the Products; (xi) accessing any content on the Products through any technology or means other than those provided or authorized by the Service; (xii) submitting to the Products or to us any personally identifiable information, except as necessary for the establishment of your account; or (xiv) bypassing the measures we may use to prevent or restrict access to the Products, including without limitation features that prevent or restrict use or copying of any content or enforce limitations on use of the Products or the content therein.

If you violate these restrictions at any time we reserve the right to suspend and/or terminate your account and access to the Products without any obligations or liability to you.

2. Your Content
a. Posting content

Cruncho allows you to post content, including photos, comments, links, and other materials. Anything that you post or otherwise make available on our Products is referred to as "User Content." You retain all rights in, and are solely responsible for, the User Content you post to Cruncho.

b. How Cruncho and other users can use your content

You grant Dream Troopers AB and its users a nonexclusive, royalty-free, transferable, sublicensable, worldwide license to use, store, display, reproduce, modify, create derivative works, perform, and distribute your User Content on Cruncho for the purposes of operating, developing, providing, and using the Dream Troopers AB Products. Nothing in these Terms shall restrict other legal rights Dream Troopers AB may have to User Content, for example under other licenses. We reserve the right to remove or modify User Content for any reason, including User Content that we believe violates these Terms or our policies.

c. How long we keep your content

Following termination or deactivation of your account, or if you remove any User Content from Cruncho, we may retain your User Content for a commercially reasonable period of time for backup, archival, or audit purposes. Furthermore, Dream Troopers AB and its users may retain and continue to use, store, display, reproduce, modify, create derivative works, perform, and distribute any of your User Content that other users have stored or shared through Cruncho.

d. Feedback and Improvements

You may choose to or we may invite you to submit comments, suggestions, feedback, or ideas about the Products, including without limitation about how to improve the Products ("Ideas"). By submitting any Idea, you agree that your disclosure is gratuitous, unsolicited and without restriction and will not place Dream Troopers AB under any fiduciary or other obligation, and that we are free to use the Idea without any additional compensation to you, and/or to disclose the Idea on a non-confidential basis or otherwise to anyone. You further acknowledge that, by acceptance of your submission, Dream Troopers AB does not waive any rights to use similar or related ideas previously known to Dream Troopers AB, or developed by its employees, or obtained from sources other than you.

3. Copyright Policy / ECD

You shall be responsible for handling and processing notices of alleged infringement by User Content in accordance with the European Electronic Commerce Directive (or any successors thereto or similar laws in foreign jurisdictions) (“ECD”) and shall promptly notify Dream Troopers AB if you become aware of any such notices or takedown requests. Notwithstanding the foregoing, without limiting Dream Troopers AB’s other rights and remedies hereunder, Dream Troopers AB reserves the right to respond to any ECD notices it receives in accordance with its ECD policies and to suspend or terminate access to the Product for repeat infringers.

4. Security

We care about the security of our users. While we work to protect the security of your content and account, Dream Troopers AB cannot guarantee that unauthorized third parties will not be able to defeat our security measures. Please notify us immediately of any compromise or unauthorized use of your account.

5. Third-Party Links, Sites, and Services

Our Products may contain links to third-party websites, advertisers, services, special offers, or other events or activities that are not owned or controlled by Dream Troopers AB. We do not endorse or assume any responsibility for any such third-party sites, information, materials, products, or services. If you access any third party website, service, or content from Cruncho, you do so at your own risk and you agree that Dream Troopers AB will have no liability arising from your use of or access to any third-party website, service, or content.

6. Termination

Dream Troopers AB may terminate or suspend this license at any time, with or without cause or notice to you. Upon termination, you continue to be bound by Sections 2 and 6-12 of these Terms.

7. Indemnity

You shall indemnify, defend, and hold harmless Dream Troopers AB from and against any and all third party claims, costs, damages, liabilities, and expenses (including reasonable attorneys’ fees and costs) arising out of or in connection with any claim based on (a) any User Content or (b) your use of the Products (including without limitation any breach or alleged breach of these terms of service or our privacy policy).

8. Disclaimers

The Products and all included content are provided on an "as is" basis without warranty of any kind, whether express or implied.

DREAM TROOPERS AB SPECIFICALLY DISCLAIMS ANY AND ALL WARRANTIES AND CONDITIONS OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT, AND ANY WARRANTIES ARISING OUT OF COURSE OF DEALING OR USAGE OF TRADE. Dream Troopers AB takes no responsibility and assumes no liability for any User Content that you or any other user or third party posts or transmits using our Products. You understand and agree that you may be exposed to User Content that is inaccurate, objectionable, inappropriate for children, or otherwise unsuited to your purpose.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, DREAM TROOPERS AB SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOOD-WILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (A) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE PRODUCTS; (B) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE PRODUCTS, INCLUDING WITHOUT LIMITATION, ANY DEFAMATORY, OFFENSIVE OR ILLEGAL CONDUCT OF OTHER USERS OR THIRD PARTIES; OR (C) UNAUTHORIZED ACCESS, USE OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT. IN NO EVENT SHALL DREAM TROOPERS AB’S AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE PRODUCTS EXCEED ONE HUNDRED EURO (EUR 100.00).

10. Complaints

Dream Troopers AB shall settle your complaints via the email address [email protected] We shall send information about your complaint settlement to your email address. Your complaint should include description of the problem as a basis of the complaint filing and you shall specify your data, e.g. name, email address and phone number.

Dream Troopers AB shall inform you about your complaint settlement to the email address you gave within 30 days from receiving the complaint.

11. Governing Law and Jurisdiction

Dream Troopers AB and yourself expressly agree that all our mutual relations shall be governed by the law of Sweden. Dream Troopers AB and yourself agree on the subject-matter and local jurisdiction of the general court in Sweden.

12. General Terms
Notification Procedures and changes to these Terms.

Dream Troopers AB reserves the right to determine the form and means of providing notifications to you, and you agree to receive legal notices electronically if we so choose. We may revise these Terms from time to time and the most current version will always be posted on our website. If a revision, in our sole discretion, is material we will notify you. By continuing to access or use the Products after revisions become effective, you agree to be bound by the revised Terms. If you do not agree to the new terms, please stop using the Products.

Assignment.

These Terms, and any rights and licenses granted hereunder, may not be transferred or assigned by you, but may be assigned by Dream Troopers AB without restriction. Any attempted transfer or assignment in violation hereof shall be null and void.

Entire Agreement/Severability.

These Terms, together with the Privacy Policy and any amendments and any additional agreements you may enter into with Dream Troopers AB in connection with the Products, shall constitute the entire agreement between you and Dream Troopers AB concerning the Products. If any provision of these Terms is deemed invalid, then that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions of these Terms will remain in full force and effect.

No Waiver.

No waiver of any term of these Terms shall be deemed a further or continuing waiver of such term or any other term, and Dream Troopers AB's failure to assert any right or provision under these Terms shall not constitute a waiver of such right or provision.
